Helping You File For Divorce Or Marriage Dissolution
There are two legal options for ending your marriage in Ohio: divorce or dissolution of marriage. To get a divorce, you or your spouse must have lived in the state for at least six months and in the county where you are filing for a minimum of 90 days. You must also allege fault on the part of the other spouse. Among other grounds listed in the statute, the grounds for divorce that the state recognizes are incompatibility, adultery, living separate and apart for more than a year, extreme cruelty, gross neglect of duty, imprisonment and habitual drunkenness.
If you and your spouse mutually decide to end your marriage and agree on everything important, you can seek a dissolution of marriage (often thought of as an uncontested divorce). You and your spouse do not have to have grounds for a dissolution of marriage so long as the two of you are in agreement. Regardless of which path you choose, we can protect your rights and fight for your interests.
Strong Advocates In Marital Asset Division
When a marriage ends, issues involving the couple’s property are often among the most contentious. Under Ohio law, all assets and property acquired during the marriage by either spouse are considered to be marital assets. Because Ohio is an equitable distribution state, those assets must be divided in a manner that is considered equitable though not necessarily even. By ensuring the court has complete and accurate financial information, we provide skilled advocacy in property distribution matters, advancing your right to a fair division.
Guiding Clients Through Child Custody And Support
In any divorce involving minor children, the welfare of those children takes precedence over all other issues. We work diligently to protect your child’s rights as well as your parental rights. Drawing on our extensive family law experience, we can assist you with child custody and visitation as well as child support. We represent both your interests and the interests of your children in these important matters.
Assertive Counsel For Alimony
Alimony, which is actually spousal support, consists of payments made by one spouse to the other. Courts award spousal support based on a number of factors including, but not limited to the length of the marriage, income of each party, the standard of living during the marriage, and the age and health of each spouse. We routinely help clients draft both temporary and permanent spousal support agreements.
